Gabriel AubryThe temporary emergency protection order against Gabriel Aubry has been lifted.

The Canadian model was banned from seeing his four-year-old daughter Nahla following a brawl on Thanksgiving with Nahla's mother Halle Berry's boyfriend Olivier Martinez, but a judge ruled on Tuesday to remove the court order.

According to RadarOnline, "[Gabriel] will be allowed to resume visitation with Nahla, with unspecified precautions in place to protect her safety." The ruling comes after it was revealed Gabriel is seeking a restraining order against Olivier, preventing him from having any contact with Nahla.

"Gabe will ask the judge to prohibit Martinez from having any contact with Nahla. Gabe believes that the judge will be disturbed by the fact that Olivier suddenly inserted himself into the custody hand off on Thursday. Halle's nanny/housekeeper is supposed to be the go-between for the parents when Gabe picks up and drops off Nahla," a source said.

Alec BaldwinAlec Baldwin's stalker has been charged with violating the protection order against her.

Canadian actress Genevieve Sabourin, 40, was taken away in handcuffs from a Lower Manhattan court in New York on Tuesday after it was revealed she had been tweeting about the 30 Rock actor and his wife Hilaria Baldwin.

One tweet sent on November 8, which she tagged Hilaria in, said, "How Hilaria Baldwin beZEN, peaceful yogi, Alec Baldwin keep my INJUSTICE+break my life? (sic)." Her lawyer Maurice Sercarz, also quit after revealing she owes him money and has not been taking his advice. According to the New York Post, he told the judge, "Miss Sabourin feels it is a good idea to Tweet, to appear on television and discuss the case in the media contrary to my advice."

Genevieve also claimed she was being unfairly punished, saying, "I've been vilified around the world more than is possible to handle in this case. I'm being treated like a guilty person. This has destroyed my life."

The 36 year-old model is seen with an extremely swollen black eye and several lacerations on his face. He was also treated for broken ribs and a swollen face following the fight on Thanksgiving. His hands were also photographed by the police to prove that he was not involved in the fight, as his lawyers are set to accuse Martinez of prompting the brawl.

Aubry is now claiming that Martinez threatened to kill him, and sought and acquired a restraining order against the restaurateur. He is also seeking to have the emergency protective order Halle filed against him for her and their daughter lifted.

Katt WilliamsAlthough Katt Williams is known for his over-the-top behavior, one man who attended a recent concert of his feels that the comedian didn't actually deliver much of a performance at all.

Brian Herline is suing the 39 year-old and concert promoter Live Nation on behalf of all the other concert attendees of Williams' November 16 show in Oakland, California. According to the lawsuit - which was filed last Wednesday in Alameda County, California - Herline claims that Williams ended his show ten minutes after he "confronted a heckler, took his clothes off, and attempted to fight at least three audience members."

Herline seeks to claim unspecified damages for "Katt Williams' non-performance" from the lawsuit.

Neither Williams nor Live Nation have commented on the lawsuit.

Halle Berry with daughter NahlaThings are getting more heated in Halle Berry's custody battle over daughter Nahla with her ex, Gabriel Aubry.

After receiving a temporary protective order against Aubry after his Thanksgiving brawl with Berry's current boyfriend Olivier Martinez, the 46 year-old actress is now looking to make the order permanent. The emergency order will be lifted on Tuesday, but if the Cloud Atlas star acquires a more lasting protective order against Aubry, he may not see his 4 year-old daughter for an undetermined amount of time.

"If Gabriel can't control himself enough to protect Nahla from emotional trauma, it's too risky for him to be around the child, Halle, or her fiance," a source said.

The incident comes shortly after Berry lost her fight in court to Aubry - who lives and works in Los Angeles - over the ability to move Nahla to Martinez's native France.

The Liz & Dick star - whose probation is tipped to be revoked over the next few days after she allegedly lied about being behind the wheel during a car crash in June - said she respects the law since going to jail two years ago and claims she has never been drunk while filming unlike Elizabeth Taylor, who she plays in the new Lifetime TV movie.

"Elizabeth was drunk on sets. I've never been drunk on set, ever. I did my time and I respect the law. As hard as it was for me to admit it when I was in denial, it was a blessing in disguise. I was in solitary confinement and I took the time to really get into the right headspace," she said.

But she admitted if she could she would advise her 16-year-old self, "Don't drink and drive. And be careful who you surround yourself with."

During the hearing, Shanelle's attorney Michael Kretzner referred to the Department of Child and Family Services report, which concluded that the accusations of emotional abuse were "substantiated," but their investigation into allegations of physical abuse by the 14-year-old actress's mother was "inconclusive."

The "Can't Be Tamed" singer - who was left terrified when intruder Jason Luis Rivera broke into her property wielding a pair of scissors in September - has obtained a protection order against him even though he is still behind bars as she fears for her safety once he is released. The 40-year-old intruder was sentenced to 18 months in jail, although he is expected to be released in May 2013 due to overcrowding, and the 19-year-old starlet was eager to secure a permanent stay away order.

Miley - who is engaged to 22-year-old actor Liam Hemsworth - has refused to move home in spite of the terrifying incident during which Rivera attempted to enter her gated mansion claiming to be her husband. A source close to the star has previously said, "She doesn't plan on moving from her home and will not allow crazy people ruin her life. When she is home, she has her own security team that she trusts and is confident they would protect her. She will not be affected by the incidents that have happened recently at her house. She is relieved that no one was injured and hurt but moving is not an option."
