The model is unlikely to face charges over last week's brawl with the French actor - which occurred when he took his four-year-old daughter Nahla back to the home she shares with mother Halle Berry and her current partner - but documents appear to show he was at fault for the physical row.

According to documents obtained by website TMZ, after interviewing Gabirel, Halle and Olivier, the investigating officer concluded, "Suspect [Gabriel] arrived at victim's [Olivier] residence for child custody exchange. Suspect and victim engaged in verbal altercation. Suspect became upset and attempted to punch victim's head but missed and struck victim's right shoulder instead. Victim returned with three punches to the suspect's head, causing him to fall to the ground. Victim's fiancee notified police. Victim defended himself and punched the suspect."

The Canadian model - the father of Halle Berry's four-year-old child Nahla - was involved in a vicious altercation with the French actor, who is engaged to the brunette actress, on Thanksgiving when he was dropping his daughter back to her mother's house - but he claims to have done "absolutely nothing" to "provoke" Olivier.

"Gabe wants criminal charges brought against Olivier for beating the living daylights out of him on Thanksgiving. Gabe can't believe that he was the one arrested when he says he did absolutely nothing to provoke the attack. If you look at the pictures of Gabe's hands after the fight, there isn't one scratch, nor did he suffer any wounds to his hands, as Olivier did. Gabe says he was rendered defenseless because he was knocked to the ground by Olivier's punches. Remember, Olivier's father was a former professional boxer and he has trained for years also," a source close to the situation said.

The Fashion Star mentor and fiance Eric Johnson are set to have their second baby together just seven months after Jessica gave birth to their daughter, Maxwell Drew Johnson, on May 1.

"It definitely wasn't planned. But yes, Jessica is pregnant again," a source said.

Jessica, 32, has previously said of her daughter: "Motherhood is a dream, it really is absolutely amazing." The former singer has been engaged to NFL player Eric, 33, for two years, and it was rumored they had been planning to tie the knot in Italy next year.

Shortly after giving birth, Jessica was named the face of slimming brand Weight Watchers, and had been working hard with trainer Hayley Pasternak to lose some of the 60lbs she gained during her first pregnancy.

Jacqui Ainsley and Guy RitchieGuy Ritchie has become a father for the fourth time. The Snatch director's fiancee Jacqui Ainsley - with whom he already has a 14-month son, Rafael with - gave birth to a little girl at a private London hospital and both mother and baby are doing well.

"They are both utterly delighted at the birth. The fact they now have a girl is an added bonus - Guy always wanted a boy and a girl," a friend told The Sun.

No further details about the birth or the baby have been revealed.

As well as his two children with Jacqui, Guy, 44, has sons, Rocco, 12, and seven-year-old David from his marriage to Madonna.

Guy and Jacqui - who recently got engaged - confirmed they were expecting their second child together, after she was pictured on the red carpet sporting a baby bump.

Gabriel AubryThe temporary emergency protection order against Gabriel Aubry has been lifted.

The Canadian model was banned from seeing his four-year-old daughter Nahla following a brawl on Thanksgiving with Nahla's mother Halle Berry's boyfriend Olivier Martinez, but a judge ruled on Tuesday to remove the court order.

According to RadarOnline, "[Gabriel] will be allowed to resume visitation with Nahla, with unspecified precautions in place to protect her safety." The ruling comes after it was revealed Gabriel is seeking a restraining order against Olivier, preventing him from having any contact with Nahla.

"Gabe will ask the judge to prohibit Martinez from having any contact with Nahla. Gabe believes that the judge will be disturbed by the fact that Olivier suddenly inserted himself into the custody hand off on Thursday. Halle's nanny/housekeeper is supposed to be the go-between for the parents when Gabe picks up and drops off Nahla," a source said.

"I'm not a real big on the whole Santa thing. I thought it was a huge act of betrayal when I was a kid. I didn't like that. When I found out the truth, I was like, 'Why, why, why would you lie to me, why?' So what I tell them is some people believe it's Santa, and some people believe it's parents, and you get to believe whatever you want," he told E! News.

Brad also admitted he can be too strict with his sons. While the Killing Them Softly actor says he is a soft touch when it comes to his daughters with Angelina Jolie, he is harder on the boys: "I'm more of a disciplinarian with the boys. The girls do no wrong, of course. Mom's a little more equal in her dishing."

The singer recently revealed how excited he is about his first Christmas as a father: "Me about to be a father is going to be the best Christmas memory I think I'm ever going to have. We're due any day now and we're so ready for it. I'll probably be changing diapers all over Christmas and I cannot wait. We'll be here in Los Angeles, and my wife's family are flying out. Finally Christmas is going to be at my house. Normally I'd fly back to Orlando to my parents but this year my wife and I have our own Christmas tree. We've got a Nightmare Before Christmas tree, it's not black but it's got all the characters. It's pretty gothic."

Halle Berry with daughter NahlaThings are getting more heated in Halle Berry's custody battle over daughter Nahla with her ex, Gabriel Aubry.

After receiving a temporary protective order against Aubry after his Thanksgiving brawl with Berry's current boyfriend Olivier Martinez, the 46 year-old actress is now looking to make the order permanent. The emergency order will be lifted on Tuesday, but if the Cloud Atlas star acquires a more lasting protective order against Aubry, he may not see his 4 year-old daughter for an undetermined amount of time.

"If Gabriel can't control himself enough to protect Nahla from emotional trauma, it's too risky for him to be around the child, Halle, or her fiance," a source said.

The incident comes shortly after Berry lost her fight in court to Aubry - who lives and works in Los Angeles - over the ability to move Nahla to Martinez's native France.
